THE ENERGY COACH INSTITUTE PARTICIPANT USE AGREEMENT

All Participants of Classes and Programs held within The Energy Coach Institute (including the Certified Energy Coach Program and other classes) agree to be bound by the following Program Parameters which govern how classes operate, give us permission to record, and constitute a release of liability. These are standard and non-negotiable conditions of your entry to our Classes and Programs.

You should only see this page once, no matter how many courses you take at the ECI. Please read the entire Agreement carefully as you will be responsible for adhering to these few rules. THE ENERGY COACH INSTITUTE PARTICIPANT USE AGREEMENT

The Maryam Webster Group ("MW") and The Energy Coach Institute ("ECI") includes participant ("Participant") support and instruction by multiple course Instructors ("Instructor" and/or "Facilitator"). Your participation in these online training programs and eCampus is bound by the following agreement:

1. Copyrighted Material. All material at The Energy Coach Institute is copyrighted to The Maryam Webster Group and/or The Energy Coach Institute, except where listed. MW, ECI, Instructors and Participant agree to respect and protect all copyrighted material provided by all parties. This includes all lessons, chapters of Classes, Recorded Audios, the individual forum posts made by all parties, look and feel of the ecampus theme, graphics and all related material.

a) Recordings: Recordings are made of each class by the ECI. By continuing to participate, Participant agrees to being recorded. Participant acknowledges and understands that in time MW/ECI may at its discretion formulate a publically vended product from these recordings and gives their permanent release for this material to be so utilised.

b) MW/ECI retains copyright to all audio, video and written material in this course. You are not allowed to share any materials from ECI courses with others.

c) Recording of calls BY Participants is strictly prohibited in accordance with this agreement. The content of all class calls remains the intellectual property of MW/ECI. Audios are available in the eCampus for your continued listening and a CD of collated audios may be made available to you for separate purchase at the end of class, should you wish to do so.

2. No Guarantee of Results. Participant acknowledges and agrees that MW/ECI makes no guarantee with respect to results achieved by Participant in connection with the ECI online training programs.

a) Participant is solely responsible for his or her own results using the Methods, Best Business Practices, Energy Therapies, Coaching Principles and other intellectual property taught in our Programs and Classes.

b) The ECI online eCampus is presented for use "as is" with no guarantee. Participant agrees that MW/ECI is not liable for having the eCampus active and in usuable condition during server malfunctions, internet congestion, natural disaster or other potential uptime losses. ECI will make concessions on due-dates for homework and the like should outages of more than 24 hours occur.

3. No Liability. ECI, MW and Instructors disclaim any personal liability on the part of its participants and graduates. To decrease Participant's personal liability for using the energy methods, Participant agrees to maintain such professional licenses and certifications that allow them to practice within the scope of their helping profession.

a) Participant shall hold MW/ECI harmless from all liability arising out of or resulting directly or indirectly from specific advice given by MW/ECI, Instructors or other Participants. Participant shall indemnify MW/ECI from any claim or action related to such advice.

Where the courts deem this agreement to be unenforcable, Participant shall assume all costs and expenses MW/ECI may incur in defending claims arising from participation. This clause is specifically, but not limited to, the following understandings:

* I understand that my physical, emotional and spiritual health is my own responsibility. Neither MW/ECI nor its Instructors assume any responsibility for my health and welfare or that of others I may practice these techniques on.


* Neither MW/ECI nor its Instructors recommend anyone cease using medical regimens, prescribed medicine, psychiatric or other therapy. In all cases please consult your medical doctor, therapist or other professional.


* While we know that many people are able to lessen or leave behind medical or psychiatric treatments with energy coaching, the energetic and changework processes in our manuals are still in the experimental stages, as yet untested over long periods of time (accupuncture being the notable exception) and should not be used as replacements for medical, psychological or psychiatric treatment.


* As a participant, student or graduate, you will not misrepresent your training at ECI by claiming to treat medical or psychiatric conditions - unless you have the relevant training, licensure and certification to do so.


* Lastly, I understand that neither ECI nor MW owes liability to myself (“my”) or those I work with ("our”) for any damage to my/our mental, physical or spiritual health arising in any way whatsoever out of my/our use of the techniques presented in the training program or in these written materials.


4. Confidentiality. ECI, MW, Instructors and Participants agree to maintain the confidentiality of all Proprietary Information in ECI. As used herein, the term "Proprietary Information" includes without limitation: any confidential information of Participant encompassed in any reports, research or developmental work, work in progress, plans, proposals, client case studies, personal information and the content of all course teleclass calls.

Confidentiality also includes all concepts or ideas, materials or information related to business, products or clients of Participant or Participant’s licenses or client data which have not previously been released to the public at large by duly authorized representatives of Participant. MW/ECI, Instructors and Participants also agree that any and all Proprietary Information shall remain the sole property of the respective owner of such Proprietary Information.

5. Our Privacy Policy. MW/ECI will respect the privacy of Participant and maintain the confidentiality of any information provided by Participant during coaching sessions with MW and Instructors. This provision shall not prevent MW/ECI from using its experiences with Participant or Instructors in preparing or enhancing MW/ECI's current and future products and services, so long as such uses do not disclose information sufficient to identify Participant or any of Participant's clientele.

To preserve Participant safety, MW/ECI may disclose information about Participant or information provided by Participant during coaching sessions if MW/ECI, in its sole discretion, determines that

(a) Participant may commit harm to themself, others or MW/ECI

(b) such disclosure is otherwise necessary to protect MW/ECI or

(c) in event of court order to so disclose
